Inspection Violations

Food Facilities: Risk Factor violations are those which, if not corrected, are likely to lead to an illness. Sanitarians work with the operators to assure that red violations have been corrected before leaving the facility. These violations can also result in follow up inspections.

Good Retail Practices violations Are related to the maintenance and cleanliness of the establishment and can lead to the development of Risk Factor violations.

Pool Facilities
Critical violations are those which, if not corrected, may result in pool closure.

Other Facilities
ARM violations are violations of the Administrative Rules of Montana. These are violations for all programs other than retail or manufactured food. Sanitarians work with facilities to correct these violations as soon as possible

Facilities who fail to correct violations within time limits given may incur regulatory action, such as follow up inspections and penalties.

ADEQUATE HANDWASHING SINKS PROPERLY SET UP AND ACCESSIBLE
6-301.14 HANDWASHING SIGNAGE. A sign or poster notifying food employees to wash their hands is not provided at all handwashing sinks. No hand washing sign at hand sink in the meat cutting room. Action: I gave them a sign to post at hand sink. 5-204.11 HANDWASHING SINKS, LOCATION AND PLACEMENT. (A) to allow convenient use by employees in food preparation, food dispensing, and warewashing areas. Handwash sink in meat room is blocked for use by equipment on it. All hand wash sinks must be accessible at all times for ease of washing. Corrected on site: equipment moved from hand wash sink.
PROPER COLD HOLDING TEMPERATURES
3-501.16 TIME/TEMPERATURE CONTROL FOR SAFETY FOOD, COLD HOLDING. (A)(2) Time/Temperature Control for Safety (TCS) foods are not maintained at or below 41 degrees F. (P) - Open air middle cooler Is not maintaining temp of 41 or colder. Potentially hazardous food must be kept at 41 F or colder to reduce the risk of food borne illness. Staff called in repair person and moved food that was below 41 F to colder part of open case, right and left side. Instructed staff to not put food in the middle of cooler case until it can maintain temp. of 41 f or colder. - Dip & Dots freezer not keeping food frozen. Ice cream was at 48 F. Staff throughout all food(ice bream ). The store leased the freezer and will end the lease.
TOXIC SUBSTANCES PROPERLY IDENTIFIED, STORED, AND USED
7-101.11 IDENTIFYING INFORMATION, PROMINENCE. Containers of poisonous or toxic materials and/or personal care items do not bear a legible manufacturer's label. Cleaning spray bottles in the meat room are not identified with contents. Label all cleaning bottles to reduce the risk of misuse.
CONTAMINATION PREVENTED DURING FOOD PREPARATION, STORAGE, AND DISPLAY
3-305.11 FOOD STORAGE. (A) Food is not being protected from contamination by storing it at least 6" above the floor in a clean, dry location where it is not exposed to splash, dust, or other contamination. Ice cream walk in freezer- box of cookies stored on the floor. Action: remove from floor to reduce the risk of cross-contamination.
UTENSILS, EQUIPMENT, AND LINENS:PROPERLY STORED, DRIED, AND HANDLED
4-903.12 PROHIBITIONS. Cleaned and sanitized equipment, utensils, or laundered linens are being stored in locker rooms, toilet rooms, garbage rooms, mechanical rooms, under unshielded sewer lines, under leaking water lines, under open stairwells or under other sources of contamination. Boxes of boxed cups stored under sewer lines in basement. Action: no food or food contact items are to be stored under sewer lines to reduce the risk of contamination from dripping pipes.
FOOD AND NON-FOOD CONTACT SURFACES CLEANABLE, PROPERLY DESIGNED, CONSTRUCTED, AND USED
4-501.11 GOOD REPAIR AND PROPER ADJUSTMENT. (A) Equipment is not maintained in a state of good repair and condition that meets the requirements specified in code. Ice cream walk in cooler- condensate is freezing in a stalagmite formation on the top shelf under condenser unit. Equipment not maintained properly and condensate may contaminate boxes of food.
WAREWASHING FACILITIES: INSTALLED, MAINTAINED, AND USED; TEST STRIPS
4-302.14 SANITIZING SOLUTIONS, TESTING DEVICES. A test kit or other device that accurately measures the concentration in mg/L (ppm) of sanitizing solutions is not provided. They have no sanitizer test strips to measure quaternary ammonium(QA) in solution. Corrected on site: I gave them some of my extra test strips and I told them where to buy more.
