Inspection Violations

Food Facilities: Risk Factor violations are those which, if not corrected, are likely to lead to an illness. Sanitarians work with the operators to assure that red violations have been corrected before leaving the facility. These violations can also result in follow up inspections.

Good Retail Practices violations Are related to the maintenance and cleanliness of the establishment and can lead to the development of Risk Factor violations.

Pool Facilities
Critical violations are those which, if not corrected, may result in pool closure.

Other Facilities
ARM violations are violations of the Administrative Rules of Montana. These are violations for all programs other than retail or manufactured food. Sanitarians work with facilities to correct these violations as soon as possible

Facilities who fail to correct violations within time limits given may incur regulatory action, such as follow up inspections and penalties.

2-102.12 CERTIFIED FOOD PROTECTION MANAGER (CFPM). (A) Facility lacks a Certified Food Protection Manager. (C) Manager could not provide a valid CFPM at the time of the inspection and was directed to several resources where he could obtain a certificate. Each facility must have a Certified Food Protection Manager. ACTION: Become CFPM certified within 45 days of the insepction.
IN-USE UTENSILS: PROPERLY STORED
3-304.12 IN-USE UTENSILS, BETWEEN-USE STORAGE. (E) During pauses in food preparation or dispensing, utensils used for non-Time/Temperature Control for Safety (non-TCS) foods are not stored in a clean, protected location (e.g. ice scoop). (C) Ice machine scoop was a in a plastic tray with a build-up of residue inside of it. Utensils used for non-TCS foods must be stored in a clean, protected location to prevent contamination. Corrected on Site: The manager removed the plastic tray with ice scoops for cleaning.
PLUMBING INSTALLED; PROPER BACKFLOW DEVICES
5-202.13 BACKFLOW PREVENTION, AIR GAP. The air gap between the water supply inlet and the flood level rim of the plumbing fixture, equipment, or nonfood equipment is not at least twice the diameter of the water supply inlet and no less than 1 inch. (P) The prep sink did not have a proper air gap. The air gap between the water supply inlet and the flood level rim of the plumbing fixture, equipment, or nonfood equipment must be at least twice the diameter of the water supply inlet and no less than one inch to prevent the back flow of sewage and contamination of equipment. ACTION: Install a proper air gap in the prep sink drain line.
PHYSICAL FACILITIES INSTALLED, MAINTAINED AND CLEAN
6-201.11 FLOORS, WALLS, AND CEILINGS - CLEANABILITY. Floors, floor coverings, walls, wall coverings, and/or ceilings are not designed, constructed, and installed so they are smooth and easily cleanable (exception: anti-slip floor coverings or applications used for safety reasons). (C) The ceiling by the meat counter had a previous water leak that damaged several ceiling tiles. The floors, walls, and ceilings must be designed, constructed, and installed so they are smooth and easily cleanable to prevent the contamination of food and spread of bacteria. ACTION: Repair / replace the damaged and missing ceiling tiles.
